Cazul “Carpatina”

Nu vizitasem niciodată, înainte, Valea Lotrului şi nu cunoşteam bine împrejurimile din această regiune. Aveam numai oarecare infomaţii vagi despre felul cum au fost jufuiţi sistematic moşnenii de drepturilor lor şi despre sălbaticile devastări ale pădurilor de brad din această frumoasă regiune.

Am trecut prin Brezoi, comuna mare aşezată la Gura Lotrului, într-o poziţia cât se poate de pitorească, dar plină de instalaţiile “Carpatinei” şi ticsită de personalul acestei societăţi, format din străini şi înstrăinaţi.

“Carpatina” luase fiinţă înainte de 1910, prin fuzionarea a două societăţi mai mici: “Lotrul” şi “Oltul”. Împotriva acestei societăţi, aveam un puternic resentiment încă din timpul primului război mondial, considerând-o cuib de spioni şi de străini indezirabili. Dintre aceşti musafiri oploşiţi aici, care aveau toate drepturile şi nici o datorie faţă de ţara aceasta, se recrutaseră călăuzele care au condus pe alpinii bavarezi în spatele trupelor noastre. După război, nimic nu se clintise în viaţa acestei societăţi, care-şi release activitatea “normală”, cu aceleaşi peronaje cu nasuri coroiate şi cu aceleaşi rosturi sinistre.

În timpul drumului am avut ocazia să aflu multe lucruri neplăcute pe seama conducătorilor “Carpatinei” şi a mijloacelor folosite de ei, spre a se îmbogăţi pe spinarea bieţilor moşneni. Anania Colhon, moşnean şi el din comuna Malaia, mi-a povestit, în timp ce mă transporta cu căruţa sa, multe amănunte despre felul cum au fost înşelaţi moşnenii de pe Valea Lotrului, ca să li se pe nimic pădurile, În acest scop “Carpatina” a folosit mijloace din cele mai ticăloase, recurgănd în primul rând la alcool şi la serviciile unor şnapani, cum a fost un oarecare Fotache, care, prin fel de fel de tertipuri, puneau mâna pe titlurile de proprietate ale moşnenilor, lipsindu-I de dovada elementară a drepturilor lor. Pe cei mai colţoşi, îi domoleau aruncându-le şi lor un moc oscior sau înrolându-i în serviciul lor.

Cei care îndrăzneau, însă, să se împotrivească şi nădăjduiau în “Sfânta dreptate”, erau sărăciţi, până la urmă, prin procese interminabile. În mod obişnuit, la judecătoria din Brezoi, erau instalaţi “oameni de încredere” şi această instanţă judecătorească făcea impresia, mai degrabă, de oficiu al acestei societăţi. Dacă vreo victim a prepuşilor “Carpatinei” se hotăra să recurgă la sprijinul justiţiei, atunci personalul acestei judecătorii, după ce primea cuvenitul plocon drept mulţumire, căuta să-l convingă că nu are nicio şansă într-un asemenea proces, ceea ce era, de altfel, perfect adevărat. Dacă acesta se încăpăţâna şi stăruia în process, aproape în regulă general, pierdea. Cei mai mulţi împricinaţi se descurajau şi “Carpatina”, în “generozitatea” ei, se grăbea să profite de starea lor de demolarizare, spre a-şi consolida “drepturile” prin tranzacţii extreme de avantajoase pentru ea. Dacă, totuşi, unii aveau curajul să meargă şi la alte instanţe superioare – Tribunal, Curte de Apel, Casaţie – aici, nenorociţii de împricinaţi se loveau de greutăţi şi mai mari, trebuind să dea lupta cu o întreagă armată de mari avocaţi, ale căror servicii permanente fuseseră achiziţionate anticipat de “Carpatina”, la un preţ destul de mare.

Jaful pe care-l făcea această societate de străini lacomi şi fără scrupule, nu cunoştea nici o limită. Nu-i interesa decât să taie pădurile, fără nicio grijă de regenerarea lor. Şi doar existau legi silvice care prevedeau, în texte precise, dispoziţii de regenerare şi sancţiuni severe în caz de abateri. Toate aceste prescripţii ale legii, erau menite să rămână însă literă moartă, fiind sistematic ocolite sau încălcate. Cum ar fi îndrăznit vreun biet agent silvic ori pădurar, să lupte cu preaputernicii conducători ai “Carpatinei”? Lucrul acesta nu-l cuteza nici măcar şeful de ocol, care, când trebuia să verifice dacă s-au replantat sutele de mii de hectare de răşinoase tăiate, în loc să asude urcând coastele grele şi să se cocoţeze pe toţi munţii, prefera să-şi odihnească oasele ca oaspete al “Carpatinei”, unde-l aşteptau mese alese, cu păstrăvi delicioşi şi cu toate bunătăţile, stropite din belşug cu cele mai generoase vinuri!

Cât priveşte “forma” legii, ce era mai uşor decât alcătuirea unor procese verbale, în care să se afirme situaţii ireale, pe baza încredinţării unor subaltern deprinşi să măsluiască adevărul?

“Carpatina” avea, de altfel, tot felul de “consilieri”, experţi în opera de corupţie, care ştiau să aranjeze întotdeauna lucrurile. Dat pentru că statul îşi are, totuşi, organele sale superioare de control, “Carpatina” a găsit mijlocul să se aranjeze şi în privinţa aceasta. În consiliul său de administraţie, figurau în permanenţă câţiva foşti şi viitori miniştri dintre cei mai însemnaţi şi, în felul acesta, orice acţiune de supraveghere şi protecţie a statului, era frânată.

De la Brezoi, drumul mergea pe malul drept al râului Lotru, printre două şiruri de munţi înalţi, care poartă urmele devastatoarei opera de distrugere ce a avut loc în ultimele decenii pe această vale. Am trecut prin Săliştea Mălăii, apoi, după un scurt popas la Malaia, ne-am continuat drumul, călări, spre Ciunget.

Nu mai fusesem niciodată în regiunea aceasta de o sălbatică frumuseţe. Până la gura Latoriţei, am mers pe o şosea de munte pietruită şi bine întreţinută. De aci, am început să urcăm pe un drum tăiat în munte, care ajungea, în unele puncte, la 150-200 m deasupra râului. Drumeagul acesta, mai mult potecă, e atât de îngust, încât nu pot merge alături doi cai. Caii de munte sunt însă docili şi foarte bine dresaţi, astfel că te poţi lăsa fără grijă în nădejdea lor. Privind în joss pre sclipirea vălurelelor cristaline ale Latoriţei bogate în păstrăvi, te cuprindea ameţeala. Pasul sigur al cailor domoli, care merg în şir după felul muntenesc, îţi dă însă încredere deplină.

La Ciunget, am stat o vară întreagă în casa vestitului vânător Ion Jianu. Numai urşi împuşcase, în viaţa lui, 64 şi le ţinea răbojul cu grijă, fiindcă, deşi bătrân, spera să mai dea încă piept cu Moş Martin. În satul acesta, pierdut, între munţi şi cu totul izolat de lume, mă desfătam admirând frumuseţea naturii înconjurătoare, sorbeam cu nesaţ aerul sănătos al munţilor şi mă învioram în apa cristalină a Latoriţei. Drept hrană aveam păstrăvi, lapte, brânzeturi şi mămăligă, fiindcă pâinea se aducea de la Voineasa numai cu multă greutate. În contrast izbitor cu lipsa pâinii, era însă belşugul de tot felul de băuturi, pe care localnicii le aduc din drumurile lor care nu mai contenesc, în butoiaşe purtate în desagi.

Foloseam din plin timpul şi pentru citit, căutând să-mi consolidez şi să-mi completez cunoştinţele de drept. Şi totuşi, în izolarea aceasta, am avut norocul să mi se ceară asistenţa judiciară la o cercetare locală pe munţi, care urma să se facă într-un process dintre Universitatea Săsească din Sibiu şi moşnenii voineşari. Aflând că mă găsesc în Ciunget, am fost rugat de Vasile Comşa, primarul comunei Voineasa, să-l însoţesc la această cercetare. Fireşte, am primit cu mare bucurie, mai ales că perspectiva unei plimbări pe munţi, până la Obârşia Lotrului, era cât se poate de atrăgătoare. Ştiam câte ceva, din istorie, cu privire la uzurpările făcute în decursul timpului de această onorabilă comunitate săsească şi voiam să le fiu de folos acestor moşneni.

Pentru Puia, excursia aceasta a fost un permanent prilej de încântare şi de voie bună. Calea pe vârfurile munţilor Dobrunu, Socii, Ştefleştii, cu privelişti măreţe ce se desfăşurau panoramic până în zarea depărtată; drumul prin pădurile de brazi uriaşi, în aerul îmbălsămat şi ozonat al munţilor; popasurile de noapte în jurul focurilor immense, la care ardea câte un brad întreg, tot acest contact cu o natură primitivă, sălbatică şi măreaţă, avea farmecul noutăţii, un farmec inexprimabil.

La “Feltrinelli” pe Soci, la Vidra şi apoi la Obârşia Lotrului, am găsit aşezări omeneşti bine întemeiate, cu gospodării în regulă, unde am putut gusta odihna nopţii, în camera curate şi în paturi cu saltele moi. Era o plăcere să mergi cu aceşti moşneni viguroşi şi sfătoşi, care ne-au povestit, în tot timpul drumului, lucruri din cele mai interesante. Petre Dorc, Petre Socolescu, Andrei Oancea şi toţi ceilalţi moşneni care ne însoţeau, se întreceau să ne îngrijească şi să ne întreţină buna dispoziţie. La Vidra, au organizat chiar şi o partidă de vânătoare, însă n-am ştiut să exploatez norocul de a înregistra şi eu o ispravă vânătorească, fiindcă nişte mistreţi veritabili au fost confundaţi de primarul Comşa, tot aşa de ageamiu ca şi mine, cu porcii lui Grigore Mirion din Voineasa. Nu ne-am dat seama de realitate decât atunci când mistreţii, văzând că ne apropiem de ei, au luat-o la goană turbată, grohăind înfricoşător.

Zece zile cât a durat cercetarea, am avut parte de cea mai frumoasă vreme. Niciodată, de atunci, n-am mai avut prilejul să mai fac o excursie atât de plăcută şi de instructivă.

Reîntorşi la Ciunget, într-una din zile, am fost înştiinţat că au venit părinţii mei la Malaia şi ne aşteaptă să ne întoarcem cu toţii acasă. Ne-am făcut imediat pregătirile de plecare şi ne-am despărţit cu regret de bunele noastre gazde şi de căsuţa care ne adăpostise o vară întreagă.

Mă simţeam acum întremat pe deplin, pieptul nu mă mai supăra şi simţeam o imensă dragoste de viaţă.

The Carpatina Case

I had never visited Valea Lotrului before and I wasn't very familiar with this region. I only had some vague information about the way in which the locals (the Moșneni community) had been robbed of their rights to property and about the massacres of fir forests in this beautiful region.

I had passed through Brezoi, a big village by Gura Lotrului, situated in a perfectly beautiful position, yet filled with the industrial equipment of Carpatina, populated with its personnel, made of strangers and estranged.

Carpatina had been founded before 1910, by the fusion of two smaller companies: “Lotrul” and “Oltul”. I had stong resentment against this company even from the time of the First World War, as I considered it to be a spy nest, a nidus of undesirable strangers. From these guests that had settled here, having every right but no responsibility towards this country, some guides had been selected, leading the Alpine Bavarians behind our troups. After the war, nothing seemed to have changed in the life of this company that continued its “normal” actrivity, starring the same hoked-nosed and sinister characters.

On the road, I got to find out many unpleasant things about the leaders of Carpatina and their means of getting rich by exploiting the poor locals. Anania Colhon, one of the locals from the village of Malaia, while giving me a ride in his horsecart, he shared many details with me about the way in which locals from Valea Lotrului have been tricked into selling their forests for nothing. In this aim, Carpatina had used the most abject methods, resorting to alcohol and certain scoundrels, like a specific Fotache, who, in various ways, put their hands on the peoples' title deeds, robbing them of the elementary proof of their rights to property. The most skeptical ones were being bribed or enrolled in their service.

The ones who dared stand against this and believe in the “Holy Justice” were sunk into poverty though endless trials. Generally, at the court of Brezoi there were “trustworthy people” installed and this court had become a sort of representative for this company. If any victim of Carpatina's men decided to threat legal action, then the people from the court, after receiving their promised gift, tried to convince them to give up, as they stand no chance in such a trial, which was, all in all, perfectly true. If they continued and filed legal action, they would eventually lose. Most people got thus discouraged, so Carpatina, in its “generosity”, was always ready to take advantage of their low energy and sign more and more transactions in its own benefit. If, still, others would have the courage to file complaints to superiour courts of law, here the poor people would have to fight even greater battles with entire armies of grand attorneys, all bribed by Carpatina.

There was no more limit to the robbery pursued by this company. Their only interest was cutting the forests, not giving a damn about regeneration. And yet there were forest laws, precisely stating severe punishment for those who broke them. However, all these laws were like dead, being constantly avoided or broken. How could a regular forest guard dare fight the allmighty leaders of “Carpatina”? Not even the forest district manager wouldn't dare to do this, as, while he should verify if trees had been replanted on the hundreds of thousands of hectares of cut resinous forests, instead of tiring himself climbing all those mountains, he prefered to relax as an honored guest of Carpatina, attending luxurious meals with delicious trouts and most generous wines!

As far as the law was concerned, what could have been easier than making up some documents, stating some unreal situations, based on testimonies of some deceitful employees?

Carpatina had all sorts of advisors, for that matter, experts in corruption, always ready to fix things. But as the state also had its own means of control, Carpatina found a way to fix that too. Its managing board always contained several former or future important ministers, which meant that any control action or protection of the state was failed.

From Brezoi, the road goes on the right side of the Lotru river, between two high mountain ranges who still bare the devastating effects of the actions that took place in the last decades on this valley. We passed through Săliștea Mălăii and, after a short stop in Malaia, we continued astride towards Ciunget. I had never been to this wildly beautiful region before. Until Gura Latoriței, we went on a well paved mountain road. From here we started climbing a mountain path, reaching 150-200 m above the river, in several points. This path was so narrow that it was impossible for two horses to fit on it at once, side by side. Yet, the mountain horses are very well trained, so that one can totally rely on them. Looking down on the bright shining troutful Latorița river, one could almost lose consciousness. Still, the confident steps of the mountain horses walking in line, would restore total confidence.

In Ciunget, I stayed for one whole summer in the house of the famous hunter Ion Jianu. He had only shot bears in his life, a total of 64, and, despite his old age, he was still hoping to meet one again. In this isolated village, in the mountains, I was delighted to admire the beauty of nature, to breathe the healthy moutain air and to refresh my body in the crystal clear water of Latorița. For food, we had trout, milk, cheese and polenta, as bread was difficult to bring from Voineasa. Despite lack of bread, there was an incredible abundance of drinks, brought by locals in little barrels transported in traditional bags.

I was taking full advantage of this time for reading, completing my knowledge in Law. And despite this isolation I had the priviledge of being asked to legally assist local research in the mountains, for a future trial between the Saxonic University of Sibiu and the local Moșneni community. Finding out about my presence there, the mayor of Voineasa, Vasile Comșa, asked my assistance in this research. Of course, I was very happy to accept, especially given the amazing opportunity of walking through the mountains up to Obârșia Lotrului. I had some basic knowledge about the damage done by the honorable Saxonic community in this area and I wanted to help the locals.

For Puia, this journey was a permanent joy: the road on top of the Dobrunu, Socii, Ștefleștii mountains, the beautiful views, the road through the high fir forests in the perfumed ozonized mountain air, the night stops around the giant fires, burning one whole fir tree at once, all this contact with a primitive, untouched and wild nature was amazingly, unutterably charming.

At Feltrinelli in the Soci, in Vidra and then in Obârșia Lotrului we found amazing villages, with amazing households, where we could rest at night in clean rooms and soft beds. It was a pleasure to walk with these sturdy Moșneni who told us all kinds of interesting stories along the way. Petre Dorc, Petre Socolescu, Andrei Oancea and all the other Moșneni joining us were doing their best to entertain us. In Vidra they also took us hunting, but I lost the opportunity of a great hunting victory, as the mayor Comșa, as much as a greenhorn as I was, mistook some real wild boar for the pigs of Grigore Mirion from Voineasa. We could only tell the truth as we got close and the wild boar escaped gruntling heavily.

For ten days, while the research was done, we were blessed with an amazing weather. I have never had the opportunity of taking such a pleasant and instructive trip ever since.

Back in Ciunget, I was informed that my parents had come to Malaia to take us home. We prepared to leave and made our farewells to our kind hosts and to the little house that had sheltered us for one whole summer.

I now felt fully recovered, my chest no longer disturbed me and I felt and enormous love for life.
